1. Medical Disclaimer (Critical Notice)

UNPHASED HEALTH IS NOT A MEDICAL ORGANIZATION, AND OUR STAFF CANNOT GIVE YOU MEDICAL ADVICE OR DIAGNOSIS.

• No Medical Advice: The App's core purpose is to help users find what foods may be best for them to eat based on self-reported data. All content, insights, suggestions, and information available through the App are for general informational and educational purposes only.
• Not a Substitute: The information provided by the App is not a substitute for professional medical advice, diagnosis, or treatment.
• Consult Your Doctor: Always seek the advice of a physician or other qualified healthcare provider with any questions you may have regarding a medical condition, diet, nutritional plan, or exercise routine. Never disregard professional medical advice or delay seeking it because of something you read or experienced within the App.
• Assumption of Risk: Your reliance on any information provided by the App is solely at your own risk.

2. Eligibility & Account Creation

• Account Requirement: To use the App, you must create a personal account. You agree to provide accurate, current, and complete information during registration.
• Account Security: You are responsible for safeguarding your login credentials and for any activity happening under your account.
• Account Deletion: You have the right to delete your account at any time through the settings panel within the App.

3. Subscriptions, Trials, and Payments

• Billing Cycle: Unphased Health is a paid service billed on a monthly subscription basis.
• 7-Day Free Trial: New users may be offered a 7-day free trial. The free trial automatically converts into a paid monthly subscription unless canceled at least 24 hours before the 7-day trial period ends.
• Apple In-App Purchases: All payments, transactions, renewals, and cancellations are handled exclusively through your Apple iCloud / App Store account.
• Cancellations & Refunds: You can cancel your subscription at any time via your Apple ID settings. Because payments are processed directly through Apple, any requests for refunds must be managed through Apple Support and are subject to Apple’s refund policies.

4. User-Generated Content & Image Policies

• Image Uploads: The App allows you to upload images.
• Privacy: All images you upload remain completely private to you as an individual user. They are not shared publicly or visible to other users.
• License to Host: By uploading images, you grant Pia Elizabeth Studio LLC a limited, non-exclusive, royalty-free license to host and process these images solely for the purpose of operating the App's features for you.
• Prohibited Content & Banning: You are strictly prohibited from uploading illegal, abusive, obscene, or otherwise inappropriate images. Our human moderation team regularly reviews flagged system content. We reserve the absolute right to remove any image and permanently ban accounts that violate this policy without notice or refund.

5. Intellectual Property Rights

• Our Ownership: Pia Elizabeth Studio LLC owns all legal rights, title, and interest in and to the App, including but not limited to all source code, software, databases, functionality, designs, graphics, branding, trademarks, and logos.
• Limited License: You are granted a limited, non-exclusive, non-transferable, revocable license to download and use the App on your personal Apple device strictly for personal, non-commercial use.

6. Limitation of Liability & Warranties

• "As Is" Basis: The App is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by law, Pia Elizabeth Studio LLC disclaims all warranties, express or implied.
• Zero Liability: We are not liable for any direct, indirect, incidental, consequential, or punitive damages arising out of your use of, or inability to use, the App. This includes, but is not limited to, data loss, health complications, nutritional changes, or service interruptions.

7. Changes to These Terms

We reserve the right to modify or edit these Terms at any time at our sole discretion. We will notify you of any changes by updating the "Last Updated" date at the top of these Terms or by posting an in-app notice. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

8. Governing Law

These Terms and your use of the App are governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law principles. Any legal action arising under these Terms must be brought in the state or federal courts located in Michigan.
